Terms & Conditions
1. About us & this agreement
W3bAudit (“we”, “us”, “our”) is operated by Aasim Saeed, trading as W3bAudit (a sole trader). By scanning a site, purchasing a report, or using our Fix it remediation service (the “Service”), you agree to these Terms. Payments are handled by our Merchant of Record, who is the seller of record for the transaction and whose terms also apply.
2. Definitions
Terms such as Report, Fix it, Pro, quick-win, complex fix, site-wide fix, per-page fix, page and re-scan window have the meanings set out in our published pricing, which forms part of these Terms.
3. The Service & your authorisation
We audit a URL you provide (the rendered page, HTTP response headers, Core Web Vitals, accessibility and machine-readability/SEO signals) and produce scores, findings and — on paid tiers — a written report and optional remediation. You must own the site you scan, or have the owner’s authorisation to scan and modify it. You must not use the Service against sites you are not authorised to test, to attack or overload any system, or in breach of any law or third-party right.
4. Free tier & fair use
Free scans are provided as-is and are rate-limited to protect the Service. We may throttle, require verification, or refuse automated or abusive use. Free results show scores, finding counts and a preview only.
5. Pricing, payment & tax
Prices are as published on our pricing page, in GBP and inclusive of applicable tax. Our Merchant of Record collects payment and remits VAT/sales tax. Subscriptions renew automatically until cancelled.
6. Reports
A Report is a point-in-time diagnostic of the site as it existed when scanned, for the site size purchased. It includes how-to-fix guidance and exports, and re-scans of the same URL within the 7-day re-scan window. A Report is information and guidance; implementation is your responsibility unless you also purchase Fix it.
7. Fix it (agentic remediation)
When you purchase Fix it, our agent generates and — where you grant access — applies fixes to your live site. The following apply and are disclosed and acknowledged at checkout:
- Access & method. Applying fixes requires you to connect a scoped, session-only credential (your host/Cloudflare, Git provider or CMS) or to apply the ready-to-apply patches we generate. Fixes that cannot be applied without access are delivered as patches with guidance.
- Your approval governs. We operate a preview → approve → apply → re-audit → undo model. No change is made to your live site without your explicit approval, and you are responsible for reviewing each change before approving it.
- Scope. Fix it covers quick-wins for the purchased site size. Complex or architectural fixes are excluded — they are advisory only and quoted separately.
- Backups & reversibility. Supported changes are reversible, but you are responsible for maintaining your own backup before approving changes.
- No guaranteed outcome. The Service is provided on a best-effort basis. We do not guarantee any particular score, uptime, ranking, traffic or revenue outcome; search-engine and commercial results depend on factors outside our control.
- Third parties. You remain responsible for the terms of your own hosting, Git, CMS and CDN accounts, and for any third-party paid services a fix may recommend.
8. Data & zero-retention
The page content we analyse and any credentials you provide are used only for your session and are never stored or logged. Only derived findings and scores are persisted, and only if you opt into an account. Credentials use least-access scopes and are discarded at session end. Our Privacy Policy governs personal data (such as an account email); billing data is handled by our Merchant of Record.
9. Intellectual property
We retain all rights in the Service, engine and report templates. You receive a licence to use the report and any generated fixes or patches for your own site(s). You are responsible for deploying generated fixes.
10. Warranties & disclaimers
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. Automated audits may not detect every issue and may report false positives.
11. Limitation of liability
To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with the Service is limited to the amount you paid in the 12 months preceding the claim (or, for a one-off purchase, the price of that purchase). We are not liable for indirect or consequential loss, loss of profit, data, traffic or goodwill, or for changes you approved and we applied at your direction. Nothing limits liability that cannot be limited by law.
12. Refunds & cancellation
All sales are final. By purchasing, you expressly request immediate delivery/commencement and acknowledge that you thereby waive the 14-day cancellation (“cooling-off”) right for the digital report and any completed remediation. One-off digital products (Report, Fix it) are therefore non-refundable once delivered or performed.
This does not affect your non-excludable statutory rights: if a product is faulty, not as described, or not of satisfactory quality, you are entitled to a remedy — which we will usually provide as a re-run, repeat performance, or service credit, and a refund where the law requires. Subscriptions may be cancelled at any time, effective at the end of the current billing period; there are no partial-period refunds. Where a refund is due, it is processed by our Merchant of Record.
13. Suspension & termination
We may suspend or terminate access for breach of these Terms, abuse, or unlawful use.
14. Changes
We may update these Terms and our pricing. Material changes will be notified and apply to future purchases; the version in force at the time of your purchase governs that purchase.
15. Governing law & contact
These Terms are governed by the laws of England and Wales and subject to the exclusive jurisdiction of its courts. Questions: [email protected].
